These terms are the deal between you and Gulp Games ("we", "us") for the mobile game Mob Surge (the "Game"). By installing or playing you accept them. If you do not, please do not play. Our Privacy Policy explains how we handle data and is part of these terms.
1. Who can play
You must be at least 13 years old (16 in the EEA and UK) or have a parent or guardian's permission. The Game is rated 12+ / Teen and is not directed at younger children. If you are under 18, a parent or guardian must agree to these terms and is responsible for any purchases.
2. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own, for your own entertainment. We keep all rights to the Game, its code, art, sound, names and logos. You may stream or record gameplay for non-commercial or ad-supported video content; you may not sell the Game or its assets.
3. No account, one profile
The Game creates an anonymous profile on first launch and saves it to our servers. There is no login, so the profile belongs to the device it was created on; we cannot move it to another device or recover it after you delete it or the device. Purchases are tied to your Apple or Google account and can be restored from Settings, Shop or VIP.
4. Virtual items and currency
Coins, gems, nukes, airstrikes, missiles, skins, pass tiers, event tokens and other in-game items are licensed, not sold. They have no real-world value, cannot be cashed out, transferred or traded, and may be changed or removed when we rebalance the Game. We may adjust prices, drop rates, costs and rewards at any time through live configuration.
5. Purchases, subscriptions and refunds
- Purchases are made through the Apple App Store or Google Play under their terms. Prices include any applicable tax and are shown before you confirm.
- VIP Weekly and VIP Monthly are auto-renewing subscriptions. They renew at the price shown unless you cancel at least 24 hours before the current period ends. Manage or cancel them in your Apple or Google subscription settings; deleting the Game does not cancel a subscription.
- The Premium Pass covers the current month's season only. The Starter Pack can be bought once.
- Refunds are handled by Apple or Google under their policies. Where the law gives you a right to a refund we honour it. Virtual items you have already used are not refundable except where the law requires.
6. Ads
The Game shows ads. Rewarded ads are always optional and state their reward before you tap. Interstitial ads appear between levels and are removed by Remove Ads, VIP or an active Starter Pack. You can refuse personalised ads in the consent form; ads then continue without personalisation.
7. Fair play
Do not cheat, use bots, mods, hacks or exploits, tamper with purchases or save data, attack our servers, or use an offensive call sign on the leaderboard. We may reset a profile, remove a leaderboard entry, change a call sign, or suspend or ban a profile that breaks these rules, without refund.
8. Changes and ending the Game
We update the Game, its content, economy and events regularly, and may update these terms. For material changes we show a notice in the Game; continuing to play after that means you accept the new terms. We may stop offering the Game or any part of it (including online features such as the leaderboard) with reasonable notice. Virtual items are not refundable when the Game ends, except where the law requires.
You can stop using the Game at any time by deleting it. To delete your data as well, use Settings → Delete My Data first.
9. Disclaimer and limitation of liability
The Game is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about availability, fitness for a particular purpose or error-free operation, and we are not liable for indirect or consequential loss, lost progress, lost virtual items or lost profits. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us for the Game in the 12 months before the claim. Nothing here limits rights you have as a consumer that cannot be waived.
10. Law and disputes
These terms are governed by the laws of the country where Gulp Games is established, without affecting mandatory consumer protection rules where you live. Please contact us first; most problems are solved by email within a few days. Courts of your home country have jurisdiction where consumer law requires it.
